Yes, for now. Kalshi, Polymarket US and Novig all operate in New York, sports included, and Novig is the official prediction market partner of the Mets. But New York is the state with the most moving parts: the attorney general put out an industry alert on January 30, 2026, the CFTC responded by suing the state pre-emptively, a proposed class action against Kalshi is pending in Manhattan federal court, and a bill called the ORACLE Act would tighten oversight. None of it has changed what you can trade yet. Status as of October 15, 2026.

The legal picture
New York legalised online sports betting in 2022 and taxes it at 51% of revenue, the highest rate in the country. Prediction markets offer the same games at 18+ with a small exchange fee and no state tax, which is why the state and its licensed operators care. The sequence so far:
- November 2025: a proposed class action is filed in the Southern District of New York alleging Kalshi runs unlicensed sports betting.
- January 30, 2026: the attorney general issues an industry alert on prediction markets.
- Following that: the CFTC sues New York pre-emptively to defend federal jurisdiction over event contracts. A preliminary-injunction hearing was held in the Southern District of New York on September 14, 2026; no ruling had been reported by mid-October.
- 2026 session: the ORACLE Act is proposed in the legislature to tighten oversight and potentially prohibit some contract types.
No court has ordered any platform to geofence New York. The federal pre-emption question that decides all of this is now in front of the Supreme Court via New Jersey's petition, filed September 2, 2026, with Kalshi's response due in November.
