Is Kalshi legal in Nevada?

Nevada is the state the prediction markets are losing. Its Gaming Control Board obtained a restraining order against Kalshi in March 2026, and on August 28, 2026 a Ninth Circuit panel ruled 3–0 that Kalshi's sports contracts are likely sports gambling under state law, not federally shielded swaps. Kalshi's sports, election and entertainment boards are blocked for Nevada users; Polymarket US is geoblocked under a May 29 injunction; Novig and ProphetX excluded Nevada from launch. Kalshi has asked the full Ninth Circuit to rehear. Status as of October 15, 2026.

The legal picture

The Ninth Circuit's August ruling is the strongest appellate statement so far that states can regulate these contracts as gambling. It directly contradicts the Third Circuit's April ruling for Kalshi in New Jersey, which is why the Supreme Court is now being asked to resolve the split. Nevada regulators have also pursued contempt findings against Kalshi, alleging it didn't fully comply with the state's orders; Kalshi disputes that. Separately, the panel sent election-contract questions back to the district court.

What to do

  • Don't expect sports or election contracts in Nevada on any platform until the Ninth Circuit rehearing or the Supreme Court changes the law.
  • Economics markets on Kalshi are the exception; verify in the app.
