It's the most finely balanced state in the country. Massachusetts sued Kalshi in September 2025; on January 20, 2026 a Suffolk Superior Court judge enjoined Kalshi's sports contracts, and since February that order has been stayed while the Supreme Judicial Court decides Kalshi's appeal, argued in early May. So today Kalshi's sports boards are live in Massachusetts under the stay, Polymarket has halted sports there, Novig operates, and everyone is waiting on the SJC, whose justices sounded sceptical of Kalshi at argument. Status as of October 15, 2026.

The legal picture
Massachusetts has a licensed online sports betting market and an attorney general who moved early. Unlike most states, the case is in state court, which means the question is whether Kalshi's contracts are wagering under Massachusetts law and whether federal pre-emption shields them, decided by the state's highest court rather than a federal circuit. The injunction exists; it just isn't in force. If the SJC affirms it, sports contracts go dark in Massachusetts; if it reverses, they continue. Either way the federal pre-emption question ultimately belongs to the Supreme Court via New Jersey's petition.
What to do
- You can trade Kalshi sports contracts today, but a ruling could end that with little notice; don't hold large open sports positions you'd mind having settled early under Kalshi's notice.
- Non-sports markets are not at issue.
